What Kinds of Personal Information Do We Collect?

How Do We Collect Personal Information?

We collect Personal Information directly from you, as well as automatically through your use of our Services.

Our website will generate the metadata associated with communications made using any website contact forms. When Do We Share Personal Information?

The following third-parties process or store Personal Information for the reasons set forth in this Notice. The use of Personal Information by a third-party is generally governed by that entity’s privacy notice and its contract with TeamBuildr.

We do not share your PII with third parties so that they can advertise goods or services to you.

If you consent by opting in, we allow third parties to place targeting cookies on your computer or device so that they can understand your online behavior in order to make you aware of goods or services that may be of particular interest to you.

TeamBuildr recognizes potential liability in cases of onward transfer to third parties. TeamBuildr will not transfer any personal information to a third-party without first ensuring that the third-party adheres to the Privacy Shield principles.

In addition, in the event of a sale of our company, we may transfer our rights in your Personal Information to an acquirer. This transfer would not be considered a sale under an instruction not to sell your Personal Information because it would be made in the context of a sale of our business.

It is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, by lawful request of public authorities and national security or law enforcement requirements, situations involving potential threats to the physical safety of any person, violations of Terms of Service, or as otherwise required by law.

TeamBuildr will keep your Personal Information for as long as we have a legitimate and lawful purpose to do so. The information we collect may be stored and processed in servers in the United States and wherever TeamBuildr and our service providers have facilities around the globe.

Privacy Shield

TeamBuildr, LLC complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States.

TeamBuildr, LLC has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. TeamBuildr, LLC is subject to investigatory and enforcement powers of the U.S. Federal Trade Commission.

In compliance with the Privacy Shield Principles, TeamBuildr, LLC commits to resolve complaints about our collection or use of your personal information. EU individuals with inquiries or complaints regarding our Privacy Shield policy should first contact TeamBuildr, LLC at: privacy@teambuildr.com.

TeamBuildr, LLC has further committed to cooperate with the panel established by the EU data protection authorities (DPAs) with regard to unresolved Privacy Shield complaints concerning human resources data transferred from the EU in the context of the employment relationship.

EU Persons may have the option to select binding arbitration under the Privacy Shield Panel for the resolution of your complaint under certain circumstances. EU Persons whose personal information is covered by this Privacy Shield Policy have the right to access the personal information that TeamBuildr, LLC maintains about them to correct, amend or delete such personal information if it is inaccurate or has been processed in violation of the Principles (except when the burden or expense of providing access, correction, amendment, or deletion would be disproportionate to the risks to the Data Subject’s privacy, or where the rights of persons other than the Data Subject would be violated). If Personal Data covered by this Privacy Shield Policy is to be used for a new purpose that is materially different from that for which the Personal Data was originally collected or subsequently authorized, or is to be disclosed to a non-agent third party, TeamBuildr, LLC will provide Data Subjects with an opportunity to choose whether to have their Personal Data so used or disclosed. To the extent required by the Privacy Shield Principles, TeamBuildr, LLC obtains opt-in consent for certain uses and disclosures of Sensitive Data.

Children’s Privacy

This Site does not knowingly collect information from children under thirteen (13) years of age. If you are under thirteen (13), do not send any information about yourself to this site. In the event that we discover that a child under the age of thirteen (13) has provided Personal Information, we will immediately delete the child’s personal information.

Data Storage and Data Transfers

TeamBuildr is headquartered in the United States, but may use service providers throughout world. As such, we and our service providers may transfer your Personal Information to, or access it in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction.

Personally Identifiable Information (“PII”)

Personally identifiable information (“PII”) is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. PII includes, but is not limited to, the following if it identifies, relates to, describes, is reasonably capable of being associated with, or could be reasonably linked, directly or indirectly, with a particular consumer or household:

(B) Any of the following categories of Personal Information: information that identifies, relates to, describes, or is capable of being associated with, a particular individual, including, but not limited to, his or her name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. 

(C) Characteristics of protected classifications under California or federal law.

(D) Commercial information, including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies. 

(E) Biometric information.

(F) Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with an internet website, application, or advertisement.

(G) Geolocation data.

(H) Audio, electronic, visual, thermal, olfactory, or similar information.

(I) Professional or employment-related information.

(J) Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g; 34 C.F.R. Part 99).

(K) Inferences drawn from any of the information identified in this subdivision to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

PII does not include publicly available information. For purposes of this definition, “publicly available” means information that is lawfully made available from United States federal, state, or local government records. “Publicly available” does not mean biometric information collected by a business about a consumer without the consumer’s knowledge.

PII does not include consumer information that is deidentified or aggregate consumer information.

Non-Personally Identifiable Information (“NPII”)

Non-personally identifiable information is every kind of information except for Personally Identifiable Information.
